I work for a mental health organization, and a client is trying to find low income housing. On a back ground check it showed what his criminal charge was and that he was found under the NGRI. Is it legal for it to be available for back groundchecks since its technically Not guilty by reason of insanity. And doesn’t it follow under confidentiality.

If this person wants public housing it is perfectly legal. They do criminal background checks on all perspective tenants.

I recently moved into a new townhome and before I moved in, my landlord (who also happens to be a realtor) requested along with all of my deposits, a post dated rent check for the first months rent. He assumed me it would not be cashed until the first, as I would never have given him a check for money I didn’t have had I thought he would cash it. He ended up cashing all the checks at once! He said it was an honest mistake, which I believe. Now it seems he does not want to pay for the overdraft fees I had even though he acknowledges his responsibility. I have already spoken with my bank and there really is no such thing as post dating a check. Is he liable since we had a verbal agreement?

a verbal agreement is hard to prove in court because he can say that he did’nt say whatever. its best to get written

I have tried some sites on the internet, but unfortunately the ones that I have seen only verify that a social security number is authentic. They don’t actually tell you who the social security number belongs to… (In other words, I need to know if the social security numbers are actually there own)

I am open to any suggestions. :0)

First,check for an ID.Check if it has those seals so you can see if it’s real.Check for expiration date and all that.If it looks legit,check also the SS card.It should have a watermark on it.And check if the SS card matches the name on the ID and all.Most of the time,you must have a SSN card to get an ID,so if the ID looks legit,it’s even better.

Tha watermark on the SSN card has an orange circle,last time I checked.

Another thing,try a local agency that does background checks.They might have a special package for a small business like yours.

P.S.: You shouldn’t just run a background check on a particular ethnic group.If you run a background check on one person,you should do with everybody.Americans can have a fake social.Who knows they were a felon and don’t want to admit it?
If a legal person of another ethnic group finds out you did a check on them and not in an American person,you can be sued for discrimination and violating Equal Opportunity laws.

I work for a large hospital in Wisconsin and they recently decided they were going to send out a criminal background check survey to ALL hospital staff. They are claiming they are choosing to apply the four or five year background check required by the Caregiver law to ALL hospital staff. I work in IT and NEVER have patient contact. This seems fishy to me besides just being insulting. I was honest on my application and nothing has change in my criminal histroy (or complete lack there of) since my hiring almost four years ago. They also said if we did not fill out this form and return it we would be fired. Beyond applying the caregiver law to non-caregivers I thought it was illegal to force someone to fill something out / sign something under duress of their job? I know this doesn’t replace consulting a lawyer but looking for some guidance on where I stand and what my options are. Thanks to anyone with legal expertiese that can help.

Sorry I agree with the hospital…when my Mom was hospitalized I was a nervous wreck and today if I had a family member in the hospital I would certainly want to know the hospital had done background checks on ALL hospital staff…you have no need to be offended; the fact that you are is disturbing. Fill it out or find another job not in the health care sector.

It’s up to the apartment office if they want to accept such an arrangement. It is not inherently illegal but the apartment office has no obligation to agree to these terms.

I recently took out a payday loan and in order to do so they required I write a post dated check. I can’t afford to pay the amount right now. If I simply close out the account to avoid overdraft and NSF check fees from my bank, is that considered fraudulent and can I be criminally charged?

your account won’t actually close if new checks keep coming in. they open it up to charge you the nsf fees. fun fun fun.
just pay your bills so your credit doesn’t get any more ruined. Yes, you will be criminally charged for writing checks.

I was going to move in with a friend and his landlord/uncle kicked him out. I was out within about two weeks. I have signed no contracts or leases but offered to pay a post dated check for the cost of utilities used durring my stay. He was adimant about cash and said he could keep my army dufflebag and all ACUs and other gear inside them. What are my rights here? Is it illegal for him to steal my equipment?

they never asked about a background check. they just decided today to do one.

Typically they make you sign an application that states you will be truthful on your application. If they find out anything that proves you lied on the app, they can fire you anytime, even 10 years later.

I received a post dated check from a tenant for rent which is already very past due. There have been repeated problems every month in getting this tenant’s rent. The lease ends on Oct. 31st and I financially need to receive Sept’s rent and then serve her with a letter that her lease will not be renewed and that she needs to vacate the premises by Oct. 31st. Can I get in any legal trouble if I cash that check prior to the date on the check, of course provided the bank teller processes it before the date on the check? Could I be legally held responsible for any bank fees she may incur for other checks that may bounce due to my cashing the check now?
