Question by Kellie: Is it legal to list the status of an NGRI?
I work for a mental health organization, and a client is trying to find low income housing. On a back ground check it showed what his criminal charge was and that he was found under the NGRI. Is it legal for it to be available for back groundchecks since its technically Not guilty by reason of insanity. And doesn’t it follow under confidentiality.

If this person wants public housing it is perfectly legal. They do criminal background checks on all perspective tenants.

I’m just curious, does the background check that is done on a person before they buy a firearm have access to their medical records? What if the person has a history of mental illness, but lies on the form. Aren’t medical records private?

Once you have been fingerprinted in a police station will it come up on a criminal background check in a different county? I got offered a pretty good job in a different county from where i got booked and released, but they ask for fingerprints before they hire me. I would have to go to the Police station and get fingerprinted. Should I even bother. I haven’t gone to court for that ticket yet.

With the age of computers, once you are arrested, convicted or fingerprinted, it’s in the system and anybody that checks will see it immediately.

I was curious, my crazy ex showed me a police report involving someone really close to me to sabbatoge the relationship. Was he allowed to do that? What are the police ethics. Can they do back ground checks on your spouse for no reason? Can they run a plate from a car that sits in front of your house? Or would it be consider harrassment and an invasion of privacy? Also, what can happen if a cop is slandering you? My ex is a control freak and makes my life hell!!! Advice on how to deal with him please.

I believe police reports are public record through the freedom of information act.

What are the tests the employer will perform during the background check? Ex; Criminal record/ credit checks/ drug policy/. I was terminated from employment (for not reaching the targets of the employer. Will they inform to the new employer?

Well depending on the company they will do a criminal background . and drivers license check. Lots of companies do not do credit checks. If your last company is contacted they cannot say if you were terminated or not. All they can say is that your re-hirable or not. So chances are if you were terminated they will say no to that question which is not a great thing but not a show stopper.

Question by Christopher M: Is it legal to apply the criminal background check section of the “Caregiver” law to non-care giving staff?
I work for a large hospital in Wisconsin and they recently decided they were going to send out a criminal background check survey to ALL hospital staff. They are claiming they are choosing to apply the four or five year background check required by the Caregiver law to ALL hospital staff. I work in IT and NEVER have patient contact. This seems fishy to me besides just being insulting. I was honest on my application and nothing has change in my criminal histroy (or complete lack there of) since my hiring almost four years ago. They also said if we did not fill out this form and return it we would be fired. Beyond applying the caregiver law to non-caregivers I thought it was illegal to force someone to fill something out / sign something under duress of their job? I know this doesn’t replace consulting a lawyer but looking for some guidance on where I stand and what my options are. Thanks to anyone with legal expertiese that can help.

Sorry I agree with the hospital…when my Mom was hospitalized I was a nervous wreck and today if I had a family member in the hospital I would certainly want to know the hospital had done background checks on ALL hospital staff…you have no need to be offended; the fact that you are is disturbing. Fill it out or find another job not in the health care sector.

is a finger print back ground different than a criminal back ground? If so which one looks for more information? How? I have nothing to hide other than a speeding tickets from like over 5 years ago but I am still curious.

Depending on the job, they are generally looking for felonies. Speeding tickets are okay.

Assuming he petitioned the courts and had his juvenile records sealed, then they can only go back as far as 18. If your friend didn’t have his juvenile records sealed, then they will be able to see those too.

I know you probably won’t believe me, but the commercial sites that you have access to that do not require written permission and fingerprints are notoriously inaccurate. Most of them rely on outdated information and have NO way to ascertain the validity of their information.

The only accurate way to get a true background check is through your local police department or sheriff’s office. The local check is called a BCI ( this is a local state check) and costs between $ 18 and $ 20. The more thorough is the NCIC ( called the Fed check) and can be requested through your local State Police barracks. This is a set fee of $ 68.

In either case, you can only request your own information unless you have a signed permission and fingerprint card from the person.

The downside is you are also asking about warrants. The police will arrest you if you have your background run and have an active warrant showing.Cant get around that aspect of the law.
